iHeart CNTRL (accessible at
cntrl.iheartdigital.co.za) is a social media management platform and a wholly owned product of
IHEART DIGITAL (PTY) LTD (Registration No. 2026/453657/07), a company registered in the Republic of South Africa. All references to "the Service", "the Platform", or "iHeart CNTRL" in these Terms refer to this product and its associated services.
1. Acceptance of Terms
By accessing or using iHeart CNTRL ("the Service"), operated by IHEART DIGITAL (PTY) LTD (Registration No. 2026/453657/07), trading as iHeart Digital ("we", "us", "our"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.
2. Description of Service
iHeart CNTRL is a social media management platform and a wholly owned product of IHEART DIGITAL (PTY) LTD, that enables users to:
- Schedule, publish, and manage content across multiple social media platforms from a single dashboard.
- Connect and manage social media accounts including Facebook Pages, Instagram Business accounts, LinkedIn Profiles and Company Pages, X (Twitter) profiles, TikTok accounts, YouTube channels, Google Business Profiles, and Google Analytics properties.
- View analytics, engagement metrics, and performance reports across connected platforms.
- Manage team collaboration with role-based access control within workspaces.
- Create and manage short links with click tracking and UTM attribution via the ihrt.link domain.
- Access AI-powered content suggestions and caption generation.
3. Accounts & Registration
- You must provide accurate, complete registration information.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must be at least 18 years old or have parental/guardian consent.
- One person or entity per account unless otherwise agreed in writing.
- You are responsible for all activities that occur under your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or to violate any laws of the Republic of South Africa or any other applicable jurisdiction.
- Upload content that infringes on intellectual property rights of others.
- Transmit spam, malware, or harmful content via the Service.
- Attempt to gain unauthorised access to the Service or its systems.
- Resell, sublicense, or redistribute the Service without our written permission.
- Use the Service to publish content that violates the terms of service of any connected third-party platform.
- Circumvent any rate limits, access controls, or security measures of the Service.
5. Third-Party Platform Integrations
The Service integrates with third-party social media platforms to provide its core functionality. By connecting your social media accounts to iHeart CNTRL, you acknowledge and agree that:
- Your use of third-party platforms (Facebook, Instagram, LinkedIn, X, TikTok, YouTube, Google Business Profile, Google Analytics, WhatsApp Business) remains subject to their respective terms of service and community guidelines.
- We access your connected social media accounts via official APIs (including OAuth 2.0 authorisation) solely to provide the Service's features, including content publishing, page management, and analytics retrieval.
- You authorise iHeart CNTRL to act on your behalf when publishing content, managing pages, and retrieving data from your connected accounts.
- We are not responsible for changes to third-party platform APIs, terms, or policies that may affect the availability or functionality of integrations.
- You may disconnect any social media account from iHeart CNTRL at any time, which will immediately revoke the platform's access to that account.
6. Data Processing & Privacy
Your use of iHeart CNTRL is subject to our Privacy Policy, which describes how we collect, use, and protect your personal information in compliance with the Protection of Personal Information Act (POPIA) of South Africa. By using the Service, you consent to the data practices described in our Privacy Policy.
7. Content Ownership
You retain all ownership rights to content you create or upload. By using the Service, you grant us a limited, non-exclusive licence to store, process, and transmit your content solely for the purpose of operating the Service. This licence terminates when you delete your content or your account.
8. Service Availability
We strive for high availability but do not guarantee uninterrupted access. We may perform maintenance, updates, or changes that temporarily affect availability. We are not liable for any downtime or loss of data resulting from service interruptions.
9. Intellectual Property
The iHeart CNTRL platform, including its design, code, branding, logos, and documentation, is the intellectual property of iHeart Digital (Pty) Ltd. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
10. Limitation of Liability
To the fullest extent permitted by South African law, iHeart Digital (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of revenue, data, or business opportunities.
11. Indemnification
You agree to indemnify and hold harmless iHeart Digital (Pty) Ltd, its officers, directors, and employees from any claims, losses, or damages arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
12. Termination
We may suspend or terminate your account at any time for violation of these Terms. You may cancel your account at any time by contacting us. Upon termination, your data may be deleted after a reasonable retention period of 30 days, unless retention is required by law.
13. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email or in-app notification. The "Last updated" date at the top of this page indicates when the Terms were last revised. Continued use after changes constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
